+Gemma Terms of Use
+
+This is a license agreement for the Gemma models, between you and Google.
+
+1. Definitions.
+
+1.1. “Google” means Google LLC.
+
+1.2. “Gemma” means the large language models made available by Google under this license agreement, including the different versions and sizes of the models.
+
+1.3. “Gemma Materials” means Gemma and any and all documentation and other materials related to Gemma that are made available by Google under this license agreement.
+
+1.4. “Derivatives” means (a) any derivative works of the Gemma Materials, including any modifications, adaptations, translations, or abridgements of the Gemma Materials, and (b) any other models, software, or other materials that are created using any of the Gemma Materials.
+
+2. License Grant. Subject to your compliance with the terms and conditions of this license agreement, Google grants you a non-exclusive, worldwide, fully-paid, royalty-free, non-transferable, limited license to:
+
+2.1. access, use, copy, and prepare Derivatives of the Gemma Materials; and
+
+2.2. distribute the Gemma Materials and any Derivatives of the Gemma Materials.
+
+3. Restrictions.
+
+3.1. You may not use the Gemma Materials or any Derivatives of the Gemma Materials for any of the following purposes:
+    (a) in any way that violates any applicable law or regulation;
+    (b) for any military purpose, including but not limited to, the design, development, or production of weapons, combat, or warfare systems;
+    (c) in any way that is deceptive, harmful, unethical, or misleading;
+    (d) to generate spam or other unsolicited communications;
+    (e) in connection with any critical infrastructure, including but not limited to, the operation of nuclear facilities, air traffic control, or life support systems, where the failure of the Gemma Materials or any Derivatives could lead to death, personal injury, or severe physical or environmental damage; or
+    (f) in any way that infringes, misappropriates, or otherwise violates any intellectual property or other proprietary rights of any third party.

+3.2. You must include a copy of this license agreement with any distribution of the Gemma Materials or any Derivatives of the Gemma Materials.

+4. No Warranties. THE GEMMA MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. GOOGLE AND GOOGLE’S LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

+5. Limitation of Liability. IN NO EVENT WILL GOOGLE OR GOOGLE’S LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THE GEMMA MATERIALS OR ANY DERIVATIVES OF THE GEMMA MATERIALS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

+6. Term and Termination. The term of this license agreement will commence upon your acceptance of this license agreement and will continue in full force and effect until terminated. Google may terminate this license agreement at any time for any reason. Upon termination of this license agreement, you must cease all use of the Gemma Materials and any Derivatives of the Gemma Materials and destroy all copies of the Gemma Materials and any Derivatives of the Gemma Materials in your possession or control.

+7. Governing Law. This license agreement will be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

+8. Entire Agreement. This license agreement constitutes the entire agreement between you and Google with respect to the subject matter of this license agreement and supersedes all prior or contemporaneous oral or written communications, proposals, and representations with respect to the subject matter of this license agreement.
